Terms and conditions of use

The purpose of this document is to define the terms and conditions under which, on the one hand, Cap sur l'Ecovolontariat, hereinafter referred to as the PUBLISHER, makes the site and the services available on the site available to its users and, on the other hand, the manner in which the user accesses the site and uses its services.

Any connection to the site is subject to compliance with these conditions.

For the user, simple access to the WEBSITE of the PUBLISHER at the following URL eco-volontaire.com implies acceptance of all the conditions described below.

1 - Definition

"Cap sur l'Ecovolontariat " refers to the micro-enterprise that manages the eco-volontaire.com website SIRET N°: 823 358 452 000 14.

"Ecovolunteer" refers to anyone interested in an ecovolunteer holiday. The terms eco tourisme participatif, voyage scientifique, vacances actives, vacances utiles... may also be used.

"Organization" or "body" refers to the structures that host ecovolunteers. They may be associations, NGOs or agencies. These organizations are independent and based in France or abroad. They offer ecovolunteering trips and collect payments from ecovolunteers.

" User " means any person browsing the Sites. 

2 - Description of Cap sur l'écovolontariat services and products

The eco-volontaire.com website is dedicated to ecovolunteering. Ecovolunteering is a form of participatory tourism in which the ecovolunteer works with an organization to preserve the environment. In addition to making a financial contribution, they also give of their time. On this site, you'll also find the terms participative ecotourism, useful travel, solidarity travel, scientific travel or vacation. 

The eco-volontaire.com site puts users in touch with organizations (agencies, NGOs, associations), located in France or abroad, that offer ecovolunteering trips.
The contact service concerns organizations presented in the form of a mission sheet with a button giving access to a contact form. In this case, data (address, e-mail, telephone number) are transmitted to the partner. See RGPD

3 - Responsibility for ecovolunteering trips

Cap sur l'écovolontariat is bound by a contract with local organizations.
However, the contract for the ecovolunteering stay is concluded exclusively between the ecovolunteer and the partner organization. The partner organization is solely responsible for the ecovolunteering experience it offers. It is also responsible for the choice of its service providers and partners.

Consequently, Cap sur l'Ecovolontariat cannot be held responsible for the poor running of the stay or for any cancellation on the part of the organization. The ecovolunteer acknowledges and accepts that Cap sur l'Ecovolontariat cannot be held responsible for the actions or omissions of third parties involved in its program, over which the company has no direct control.

Cap sur l'Ecovolontariat cannot under any circumstances be held responsible for loss, damage or expenses resulting from situations such as war, riots, strikes, terrorist activities, natural disasters, bankruptcies or any other event attributable to distinct third parties. Cap sur l'Ecovolontariat takes no responsibility for injury, damage, loss, accident, theft, delay or any other irregularity that may result from the failure of vehicles or equipment, or from the negligence or default of any company or person providing services related to the program.

Prior to departure, the ecovolunteer is responsible for all documents required by the organization. They are responsible for obtaining travel insurance, a valid passport, and any necessary visas or vaccinations.

3 - Payment for stays

Booking and payment for your ecovolunteering stay is made directly with the partner organization. Cap sur l'écovolontariat does not take payments or make reservations. Payment conditions are those set out in the partner organization's general terms and conditions, to which you should refer. Cap sur l'écovolontariat receives a commission from the partner organization. Cap sur l'écovolontariat makes sure that this commission weighs as little as possible or not at all on the ecovolunteer.

4 - Cancellation policy

All cancellations must be made by informing the partner organization in accordance with its general terms and conditions.

5 - How Cap sur l'écovolontariat selects partner organizations

Cap sur l'écovolontariat has selected partner organizations according to ethical criteria that meet the UN's sustainable development objectives in terms of the environment and international solidarity. 

6 - Intellectual property

The general structure of the eco-volontaire.com site, as well as the texts, graphics, images, sounds and videos that make it up, are the property of the publisher or its partners. Any representation and/or reproduction and/or partial or total exploitation of the contents and services offered by the eco-volontaire.com site, by any process whatsoever, without the prior written authorization of the PUBLISHER and/or its partners is strictly forbidden and may constitute an infringement within the meaning of articles L 335-2 et seq. of the French Intellectual Property Code.

7 - Hypertext links

The eco-volontaire.com site may contain hypertext links to other sites on the Internet. Links to these other resources will cause you to leave the eco-volontaire.com site. 

It is possible to create a link to the presentation page of this site without the express authorization of the publisher. No authorization or request for prior information may be required by the publisher in respect of a site wishing to establish a link to the publisher's site. However, it is advisable to display this site in a new browser window. However, the publisher reserves the right to request the removal of any link it deems to be inconsistent with the purpose of the eco-volontaire.com site.

The PUBLISHER endeavours to provide access to the site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the PUBLISHER's control, and subject to any breakdowns and maintenance operations necessary for the proper operation of the site and services. Consequently, the PUBLISHER cannot guarantee availability of the site and/or services, reliability of transmissions or performance in terms of response time or quality. No technical assistance is provided to the user, either electronically or by telephone.

The publisher cannot be held responsible for any inability to access this site and/or use the services.

Moreover, the PUBLISHER can be brought to interrupt the site or a part of the services, constantly without notice, the whole without right to compensations. The user recognizes and accepts that the PUBLISHER is not responsible for the interruptions, and for the consequences which can result from it for the user or any third.

10 -Modification of conditions of use

The PUBLISHER reserves the right to modify, at any time and without notice, the present conditions of use in order to adapt them to changes in the site and/or its operation.

11 - Applicable law

Both this site and the terms and conditions of its use are governed by French law, irrespective of the place of use. In the event of any dispute, and after all attempts to find an amicable solution have failed, the French courts will have sole jurisdiction to hear the dispute.
