General terms and conditions of sale (support and consulting services)

  • "Cap sur l'Ecovolontariat " refers to the Cap sur l'Ecovolontariat website(eco-volontaire.com) operated by Biodiversity CARE sas with capital of €500 - SIRET no.: 984 791 624, headquartered at 5 rue Pétion 75011 Paris.
  • "Ecovolunteer" refers to anyone interested in an ecovolunteer holiday. The terms eco tourisme participatif, voyage scientifique, de vacances actives, vacances utiles... may also be used.
  • "Organization" or "body" refers to the structures that host ecovolunteers. They may be associations, NGOs or agencies. These organizations are independent and based in France or abroad.
  • " User " means any person browsing the Sites. 

Cap sur l'Ecovolontariat offers users of its website https://www.eco-volontaire.com a coaching service to help them find an ecovolunteering assignment.

1 - PURPOSE

These General Terms and Conditions of Sale govern the relationship between Cap sur l'écovolontariat and any non-trading individual in connection with the sale of the ecovolunteering coaching/consulting service presented on the https://www.eco-volontaire.com website.

These general terms and conditions of sale apply to all orders placed, all quotations accepted, and all sales of goods concluded with Biodiversity Care. The placing of an order, the acceptance of a quotation or the conclusion of a sale implies the purchaser's full and unreserved acceptance of these terms and conditions of sale. No derogation from these general terms and conditions of sale may be accepted without the express prior agreement of the seller.

Cap sur l'Ecovolontariat reserves the right to adapt or modify the General Terms and Conditions of Sale at any time. The modified General Terms and Conditions will then be applicable as soon as they are put online. Nevertheless, the General Terms and Conditions of Sale applicable to a contractual relationship will be those online on the site at the time the order is placed by the customer.

2 - Ecovolunteering coaching and consulting services

Cap sur l'écovolontariat offers an individual coaching service, via videoconferencing, to help you find and prepare for an ecovolunteering mission: help in choosing missions, travel advice, return from experience. Cap sur l'Ecovolontariat provides addresses of agencies, associations and NGOs that may or may not be present on the platform of the same name (see general conditions of use). The ecovolunteer chooses whether or not to use all the services offered. The coaching service comes with 2 packs. Pack Nellie Bly and Pack Charles Darwin. Cap sur l'Ecovolontariat will not make any reservations or registrations on behalf of the ecovolunteer. Cap sur l'Ecovolontariat discharges its obligation by sending the customer a PDF file containing the advice given.

3 - ORDERING INFORMATION

To validate his or her request, the ecovolunteer is advised to first make an online appointment with Cap sur l'Ecovolontariat. The purpose of this initial contact (free of charge) is to define the ecovolunteer's needs, answer basic questions and introduce the Cap sur l'écovolontariat platform and the ecovolunteer coaching service. The coaching service is ordered following this first stage, provided Cap sur l'Ecovolontariat is able to meet the ecovolunteer's request. When the ecovolunteer decides to use the coaching service, he/she pays for the service online, after giving his/her first and last name, e-mail address and accepting the terms and conditions.

4 - SERVICE PRICING

Prices are quoted in euros (currently VAT-free, so no VAT is included in the service rates - article 293 Bis of the French General Tax Code), unless otherwise indicated. Prices are those indicated on the website.

5 - PAYMENT TERMS

Payment is made online, after acceptance of the T&Cs, before the start of the service. The secure platform used for payment is Paypal. It is not necessary to have a Paypal account. Card purchases are accepted.

6 - LIABILITY

Cap sur l'Ecovolontariat undertakes to provide the services diligently, it being specified that it has an obligation of means, to the exclusion of any obligation of result. Cap sur l'Ecovolontariat can in no way be held responsible for the failure to book an ecovolunteering mission with an organization, for difficulties that may arise during the conclusion or execution of contracts between the ecovolunteer and organizations, or for difficulties between organizations and their partners.

The service offered by Cap sur l'Ecovolontariat is only an advice and time-saving service in terms of choosing ecovolunteering missions. Cap sur l'Ecovolontariat does not register the ecovolunteer with any organization. Booking and choosing a trip is the sole responsibility of the ecovolunteer.

Neither can Cap sur l'Ecovolontariat be held responsible for the poor running of the stay or for any cancellation on the part of the organization. The ecovolunteer acknowledges and accepts that Cap sur l'Ecovolontariat cannot be held responsible for the actions or omissions of third parties involved in its program, over which the company has no direct control. The ecovolunteer understands that he/she travels at his/her own risk.

Cap sur l'Ecovolontariat cannot under any circumstances be held responsible for loss, damage or expenses resulting from situations such as war, riots, strikes, terrorist activities, natural disasters, bankruptcies or any other event attributable to distinct third parties. Cap sur l'Ecovolontariat takes no responsibility for injury, damage, loss, accident, theft, delay or any other irregularity that may result from the failure of vehicles or equipment, or from the negligence or default of any company or person providing services related to the program.

Prior to departure, the ecovolunteer is responsible for all documents required by the organization. They are responsible for obtaining travel insurance, a valid passport, and any necessary visas or vaccinations.

8 - PERSONAL DATA PROTECTION

Cap sur l'Ecovolontariat is committed to respecting your privacy and processing your personal data in accordance with current legislation on the protection of privacy and individual liberties.

9 - Site access

The PUBLISHER endeavours to provide access to the site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the PUBLISHER's control, and subject to any breakdowns and maintenance operations necessary for the proper operation of the site and services. Consequently, the PUBLISHER cannot guarantee availability of the site and/or services, reliability of transmissions or performance in terms of response time or quality. No technical assistance is provided to the user, either electronically or by telephone.

The publisher cannot be held responsible for any inability to access this site and/or use the services.

Moreover, the PUBLISHER can be brought to interrupt the site or a part of the services, constantly without notice, the whole without right to compensations. The user recognizes and accepts that the PUBLISHER is not responsible for the interruptions, and for the consequences which can result from it for the user or any third.

10 - Applicable law

Both this site and the terms and conditions of its use are governed by French law, irrespective of the place of use. In the event of any dispute, and after all attempts to find an amicable solution have failed, the French courts shall have sole jurisdiction to hear any such dispute.
